Summary:Currently, there is no unified model for the method of researching and determining the best interests of the child. In practice, different practices are spread among the individual experts working in the country without a unified consolidation or codification of the applied approaches. Such a lack of methodology leads to the instrumentalisation of children and the lack of predictability in practice. The same, in turn, is also determined by the lack of normatively established criteria for the method of assessing the best interests of the child in the applicable legislative framework. The methodology examines the available good foreign practices for researching the best interests of the child, individual elements, criteria, the role that children should play themselves in the process and several tools for determining his best interests.
